How the buckets work
- A pen
- The next president signs and it is gone. Executive orders, memoranda, proclamations, guidance, appointees.
- A pen, then a process
- A final rule. Undoing it takes a new rule: notice, comment, reasons, and months, or a court throws it out first.
- A simple majority
- Congress can undo it without sixty votes: budget reconciliation for anything with a price tag, or the Congressional Review Act for rules finished late enough in 2028.
- Sixty votes
- A statute with no budget hook, a treaty, or anything the Senate has to consent to.
- Locked
- Nobody can undo it. Lifetime judges, rules killed under the Congressional Review Act, pardons, money already spent, Supreme Court precedent.
Budget reconciliation is a yearly budget process that passes the Senate with a simple majority instead of sixty votes. It only reaches provisions that change federal spending or revenue, which is why a law with a price tag can be undone by a majority and a pure policy statute cannot.
The Congressional Review Act lets Congress overturn a federal rule by simple majority inside a window after the rule is finished. Rules finished after roughly late July 2028 land in the window that opens in early 2029, so the new Congress can kill them without sixty votes.
